Important Notice

The following disclaimers apply to all tree care services provided by Atlanta Tree Masters. Please read these carefully as they contain important information about service limitations, liability, and the inherent risks associated with arboriculture and tree care services.

1. Tree Health and Survival Disclaimer

No Guarantee of Tree Survival: Atlanta Tree Masters cannot and does not guarantee the survival, health, or recovery of any tree following treatment, pruning, or other care services. Tree health is influenced by numerous factors beyond our control.

Factors Affecting Tree Health Include:

  • Weather conditions (drought, storms, extreme temperatures)
  • Soil conditions and drainage issues
  • Pre-existing diseases or pest infestations
  • Root damage from construction or utilities
  • Environmental stresses and pollution
  • Age and natural decline of the tree
  • Genetic factors and species-specific vulnerabilities

While our ISA-certified arborists use industry best practices and professional expertise, the biological nature of trees means that outcomes cannot be guaranteed.

2. Property Damage and Hidden Conditions

Underground Utilities and Infrastructure

Atlanta Tree Masters is not responsible for damage to underground utilities, irrigation systems, septic systems, or other buried infrastructure that is not properly marked or disclosed. Customers are responsible for contacting Georgia 811 (call before you dig) and identifying all underground utilities before work begins.

Pre-existing Property Conditions

We are not liable for damage to structures, landscaping, or property features that are in poor condition, improperly installed, or not disclosed during the initial assessment. This includes but is not limited to:

  • Damaged or deteriorated fencing, decking, or structures
  • Improperly installed irrigation systems
  • Unstable or damaged hardscaping
  • Plants or landscaping in poor health
  • Electrical systems not up to code

3. Weather and Natural Disasters

Atlanta Tree Masters is not responsible for tree failure, property damage, or other issues caused by severe weather events, natural disasters, or acts of God, including but not limited to:

  • Severe Storms: High winds, tornadoes, hurricanes, or severe thunderstorms
  • Weather Extremes: Drought, flooding, ice storms, or extreme temperature fluctuations
  • Natural Events: Lightning strikes, earthquakes, or other natural phenomena
  • Seasonal Changes: Normal seasonal stress, leaf drop, or dormancy periods

While proper tree care can improve tree health and stability, no tree care service can guarantee protection against all weather-related damage.

4. Pest and Disease Limitations

Tree pest and disease treatments are provided based on current industry standards and best practices. However, we cannot guarantee complete elimination of pests or diseases.

Treatment Limitations:

  • Some pests and diseases may be resistant to available treatments
  • Environmental conditions may affect treatment effectiveness
  • Re-infestation from neighboring properties is possible
  • Advanced infections may be beyond treatment capabilities
  • Multiple treatments may be necessary for effective control

Customers are responsible for ongoing monitoring and may need additional treatments as recommended by our arborists.

5. Timing and Scheduling Limitations

  • Weather Delays: Work may be postponed due to unsafe weather conditions including rain, high winds, or ice
  • Permit Delays: Municipal permits or utility coordination may cause scheduling delays beyond our control
  • Equipment Issues: Mechanical failures or equipment availability may affect scheduling
  • Emergency Priority: Emergency situations may take priority over scheduled non-emergency work
  • Seasonal Limitations: Some treatments are only effective during specific seasons

6. Estimate and Pricing Disclaimers

All estimates are based on visual inspection and available information at the time of assessment. Final pricing may vary if conditions differ from initial observations.

Pricing May Change Due To:

  • Discovery of hidden hazards or complications
  • Changes in access conditions or site requirements
  • Additional work requested by customer
  • Permit or regulatory requirement changes
  • Equipment or material cost fluctuations

Any significant changes to pricing will be discussed and approved before proceeding with work.

7. Regulatory and Legal Compliance

Customers are responsible for ensuring compliance with local ordinances, HOA requirements, and permit requirements. Atlanta Tree Masters will assist with permit applications when requested, but cannot guarantee permit approval.

Customer Responsibilities:

  • Obtaining necessary permits before work begins
  • Compliance with local tree preservation ordinances
  • HOA or neighborhood association approvals
  • Notification of neighbors when required by local law
  • Compliance with setback and easement requirements

8. Limitation of Liability

Maximum Liability: Atlanta Tree Masters' total liability for any claim, regardless of the form of action, shall not exceed the total amount paid for the specific service that gave rise to the claim.

Excluded Damages:

We are not liable for:

  • Consequential, indirect, or punitive damages
  • Loss of use, profits, or business interruption
  • Emotional distress or personal injury claims
  • Damage to property not directly related to our work
  • Claims arising more than one year after service completion

Our comprehensive insurance coverage provides protection for direct damages resulting from our negligent acts, but does not extend to all possible scenarios or outcomes.
